Terms and Conditions of HORLOCHERIE SWISS

1. Scope of Application

1.1. HORLOCHERIE SWISS, based at chemin de chandolin 5, Lausanne 1005, Switzerland, operates the website horlocherie.com, specializing in selling pre-owned, high-quality watches.

1.2. All transactions between HORLOCHERIE SWISS and its customers are exclusively governed by these Terms and Conditions. Any conflicting customer terms will not be recognized unless explicitly approved in writing.

2. Formation of Contract

2.1. Offers on the website are non-binding and subject to change.

2.2. Watches are guaranteed authentic and described as accurately as possible.

2.3. High-resolution images are provided, protected by copyright.

2.4. Unless specified, watches are shipped in a neutral box with a warranty card, Terms and Conditions, and an invoice.

2.5. Visible defects in images are considered disclosed. Watches are serviced unless otherwise noted.

2.6. Placing an order is a binding offer. A contract is finalized when confirmed by email.

2.7. If unavailable, customers will be notified via email.

2.8. The order confirmation email includes all transaction details.

3. Pricing and Payment

3.1. Prices are in Euros and final. VAT is not separately itemized.

3.2. Price adjustments require written agreement.

3.3. Shipment occurs only after full payment is received.

3.4. The invoice specifies the total price, payable upon receipt.

3.5. Payments must be made within seven business days.

4. Seller’s Right to Withdraw

4.1. Non-payment within the timeframe allows contract withdrawal. Partial payments are refunded within 30 days.

4.2. Withdrawal will be communicated via email or in writing.

5. Shipping and Risk Transfer

5.1. Orders are dispatched the next business day after payment.

5.2. Non-EU shipments require an additional day for customs.

5.3. Watches are shipped securely via DHL Express or FedEx.

5.4. Risk transfers upon receipt for consumers; upon courier handover for businesses.

5.5. Customers outside the EU are responsible for customs duties.

6. Damage During Transit

Customers must report damages to the courier and notify HORLOCHERIE SWISS within three days.

7. Right of Withdrawal

7.1. Consumers have 14 days to withdraw from the contract.

7.2. Refunds are processed within 14 days of notice.

7.3. Refunds may be withheld until the returned product is received.

7.4. Returns must include all original materials.

8. Warranty and Liability

8.1. Business customers waive liability claims for defects.

8.2. Warranty for used items is limited to one year.

8.3. Damage due to improper use is excluded from warranty.

8.4. Independent repairs void warranty rights.

8.5. Liability exclusions do not apply to gross negligence or bodily harm.

9. Supply Risk

HORLOCHERIE SWISS reserves the right to withdraw if suppliers fail to deliver.

10. Offsetting and Retention Rights

10.1. Customers may offset claims only if legally established.

10.2. Retention rights apply only if based on the same contract.

11. Identification for Transactions Over EUR 15,000

11.1. Transactions exceeding EUR 15,000 require identity verification.

12. Data Protection

HORLOCHERIE SWISS adheres to data protection laws. Personal data is collected only as necessary.

13. Copyright and Trademarks

13.1. All website content is HORLOCHERIE SWISS’s intellectual property.

14. Governing Law and Jurisdiction

14.1. Swiss law applies, excluding the UN Sales Convention.

14.2. Business disputes are under Rostock jurisdiction.
